Purpose

These general terms and conditions regulate the requirements governing the use of the website www.viniscoop.com as well as the purchase or acquisition of the products found on the website.

Acceptance

Browsing the website (www.viniscoop.com) or purchasing any of the products offered on it implies the unreserved acceptance on the part of the Customer of these general terms and conditions.

VINISCOOP SL reserves the right to unilaterally modify these general terms and conditions, which will be valid from the time of publication on the website. The Customer undertakes to read these general terms and conditions prior to purchasing the products offered.

Availability

All purchase orders received through the website (www.viniscoop.com) are subject to the availability of the products and/or force majeure affecting the provision of products and/or services. 

In the event of obstacles related to the supply of the products, or if no products are in stock, VINISCOOP SL will undertake to contact the Customer by email or telephone to offer the Customer the possibility of partial delivery or cancellation. In any case, VINISCOOP SL will reimburse any amounts resulting from the cancellation or partial delivery of the order placed by the Customer.

Prices

All prices are expressed in euros and subject to VAT. Delivery costs are not included in the purchase price and, where applicable, will be determined and detailed before finalising the purchase so the Customer is informed at all times of the amount of the delivery costs.

VINISCOOP SL reserves the right to change its prices at any time. However, changes will not affect orders or purchases for which the Customer has already received an order confirmation.

Payment methods

Payments will be made by credit or debit card through a secure payment gateway of the associated financial institution, which will verify the identity of the cardholder and the authenticity of the card, and ensure protection of the Customer’s data before authorising payment. Under no circumstances will VINISCOOP SL have access to the Customer’s bank details, nor will they be stored in any of the databases in the custody of VINISCOOP SL. 

Credit cards are subject to all corresponding checks and authorisations by the issuing bank. If the financial entity does not authorise payment, VINISCOOP SL will not be liable for any delay or non-delivery and will not be able to enter into any agreement with the Customer.

Delivery

Orders can be shipped to mainland Spain, the Balearic Islands (except Formentera), Andorra and mainland Portugal. 

For these destinations, delivery time is typically three to four (3–4) working days. Orders can also be shipped to destinations in the European Union, including Germany,  Netherlands and Belgium. For these destinations, delivery time is typically three to four (5-6) working days. The service is not available for other countries. 

VINISCOOP SL will not be responsible for any delay in the delivery of orders due to causes not attributable to VINISCOOP SL, fortuitous cases or force majeure.

Shipping costs will be borne by the Customer and will depend on the destination and the number of products purchased. Deliveries to mainland Spain will be free of charge for purchases of 12 bottles or more or for amounts greater than 60 euros.

The products will be delivered to the delivery address provided by the Customer in the purchase process. When the order is received, the Customer must check that order is correct and inform VINISCOOP SL of any possible anomaly.

VINISCOOP SL will not be liable in the event that the order cannot be delivered due to inaccurate or false data provided by the Customer, nor in the event that the delivery cannot be made for reasons beyond the control of VINISCOOP SL, such as absence of the recipient at the delivery address. 

In the event that after the fifteen-day (15) delivery period has elapsed, the order has not been delivered to the Customer, it will be returned to VINISCOOP SL, which will return the amount paid for the order and terminate the contractual relationship.

Claims and defective products

When an order is received, the Customer must check that the order is correct and notify VINISCOOP SL of any possible anomaly within a period of no more than 48 hours.

In the event that, at the time the order is delivered, the Customer finds that the packaging is broken or wet, the Customer should not accept the order. The delivery company will report the incident, and VINISCOOP SL will resend the order free of charge.

If the Customer returns the order due to an error in the content of the order or a defective product, VINISCOOP SL will undertake to correct the error, replace the defective product or, where appropriate, reimburse the corresponding amount. The cost of returning and restitution or replacement of the product will be borne by VINISCOOP SL.

Termination

In accordance with the provisions of Royal Legislative Decree 1/2007 of 16 November, approving the amended text of the General Law for the Defence of Consumers and Users, the Customer will have a period of fourteen (14) calendar days from the time of receipt of the order to exercise their right of termination without the need to justify their decision and without penalty of any kind.

The Customer must exercise their right of termination within the stipulated period by sending an email to info@viniscoop.com. The email must include their personal identity information, as well as the details of the order and reference number. The Customer must also send the products to return to VINISCOOP SL. The cost of the return will be borne by the Customer.

The right of termination may not be exercised if there are indications that the products have been opened, tampered with or exposed to unsuitable conditions. Products must be returned with appropriate protection, in their original packaging, and in optimal condition for their subsequent sale.

When VINISCOOP SL has received the products being returned and verified that they are in good condition, it will refund the amount received without deduction of costs via the same means of payment used to pay for the order within a period of fourteen (14) calendar days. 

Partial invalidity

Any invalidity or non-applicability on legal grounds of any clause in these general terms and conditions will not invalidate the remaining clauses. 

Trade marks

All trademarks, logos and emblems appearing on this site are the property of VINISCOOP, SL or of third parties who hold the corresponding licence. Use of any VINISCOOP SL trademark, logo or emblem without prior consent is expressly prohibited and is subject to protection in accordance with current industrial property law. In particular, trademarks, trade names, commercial names, logos, slogans and any type of distinctive sign belonging to VINISCOOP SL may not be used without the express written permission of VINISCOOP SL or the corresponding third-party entity.

Resolution of disputes

In the event of a dispute, as a consumer, the Customer may request out-of-court settlement of disputes in accordance with Regulation (EU) 524/2013 of the European Parliament and of Council of 21 May 2013 on the settlement of online consumer disputes amending Regulation (EC) 2006/2004 and Directive 2009/22/EC. Applicable law

These general terms and conditions will be governed by Spanish law, which will be applicable in all matters not provided for in these general terms and conditions regarding the interpretation, validity and execution of these general terms and conditions.

To resolve any dispute that may arise in the interpretation or execution of these general terms and conditions, the parties submit to the competent judicial bodies as determined by law and in accordance with their nature.
